MODEL CONSTITUTION

RESIDENTS' ASSOCIATIONS

Your representatives in IPHAS and NAPHR have been in discussion with the trade bodies, BH&HPA and NPHC to produce a model constitution for residents associations that is acceptable to all parties.

 

We have now agreed on a Model Constitution and we recommend that this is adapted for use in your park residents’ associations. It has only a few minor differences from the one we have been publishing for the last few months.

 

It incorporates the criteria in paragraph 28 of the new Implied Terms which came into force in England on 1st October 2006 .

 

By using this model constitution as a basis for your own constitution, it will be very difficult for any park owner to claim it is unacceptable.

We have heard of incidents of park owners refusing to recognise residents associations or making unreasonable demands before recognition.
